1. SCOPE
1.1 These General Conditions of Sale (known as "GTC") apply, without restriction or reservation, to all sales concluded by the company SWEET ALMIRAJ, 51 rue des frères Flavien 75020 Paris - Siret: 91865532500010 (hereinafter "Sweet Almiraj") from non-professional physical buyers (hereinafter "the Customers" or "the Customer"), wishing to acquire the products offered for sale (hereinafter "the Products") by Sweet Almiraj on the site https://www.sweetalmiraj.com (hereinafter “the Site”). The products offered for sale on the Site are as follows:
Hand crafted resin dice.
Textile creations excluding clothing made by hand (pouch, etc.).
The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the Site. The Customer is required to read it before ordering.
1.2 The choice and purchase of a product are the sole responsibility of the Customer.
1.3 Product offers are valid within the limits of available stocks, as specified when placing the order.
1.4 These Terms are accessible at any time on the Site https://www.sweetalmiraj.com and will prevail over any other document.
1.5 The Customer declares to have read these GCS and to have accepted them by ticking the box provided for this purpose before the implementation of the online ordering procedure of the Site.
1.6 These general conditions may be modified at any time and without notice by Sweet Almiraj, the applicable conditions being those in force on the date of the order by the Customer.
1.7 Unless proven otherwise, the data recorded in Sweet Almiraj's computer system constitutes proof of all transactions concluded with the Customer.
2. ACCOUNT
2.1 In order to place an order, the Customer is invited to create an account (personal space).
To do this, he must register by completing the form that will be offered to him at the time of his order and undertakes to provide sincere and accurate information concerning his marital status and contact details, in particular his email address.
The Customer is responsible for updating the information provided. He can modify them at any time by logging into his account.
2.2 The Customer can modify his data in the "my account" section and consult the history of his orders.
2.3 The Customer may also request to unsubscribe by going to the dedicated page on his personal space or by sending an email via the contact page of the Site.
2.4 In the event of non-compliance with the general conditions of sale and/or use, Sweet Almiraj will have the possibility of suspending or even closing the account of a Customer after formal notice by electronic means and which has had no effect.
Any account deletion, for whatever reason, results in the pure and simple deletion of all the Customer's personal information.
2.5 Any event due to a case of force majeure resulting in a malfunction of the Site or server, subject to any interruption or modification in the event of maintenance, does not engage the responsibility of Sweet Almiraj.
2.6 The creation of an account entails the acceptance of these general conditions of sale.
3. PRICE
3.1 The Products are supplied at the current prices listed on the Site when the order is registered by Sweet Almiraj.
3.2 The prices are expressed in Euros net of VAT (VAT not applicable according to article 293B of the General Tax Code (CGI)). These prices do not include processing, shipping, transport and delivery costs which are invoiced in addition, under the conditions indicated on the Site https://www.sweetalmiraj.com and calculated prior to placing the order. .
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
3.3 An invoice is established by Sweet Almiraj and delivered to the Customer via his personal space.
3.4 The rates take into account any reductions that may be granted by Sweet Almiraj on the Site.
These prices are firm and non-revisable during their period of validity but Sweet Almiraj reserves the right, outside the period of validity, to modify the prices at any time.
4. ORDERS
4.1 It is up to the Customer to select the Products he wishes to order on the Site, after creating his account.
Product offers are valid as long as they are visible on the Site, within the limits of available stocks.
4.2 The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.
4.3 Any order placed on the Site constitutes the formation of a contract concluded at a distance between the Customer and Sweet Almiraj.
4.4 Sweet Almiraj reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
4.5 The Customer will be able to follow the progress of his order on the Site.
5. PAYMENT
5.1 The Customer must pay his order in full on the day of placing. He can pay by credit card (Visa, Eurocard/Mastercard) or with his PayPal account.
5.2 Payment data is exchanged in encrypted form using the protocol defined by the approved payment provider involved in banking transactions carried out on the Site.
5.3 Payments made by the Customer will only be considered final after Sweet Almiraj has actually received the sums due.
Sweet Almiraj will not be required to deliver the Products ordered by the Customer if the Customer does not pay the full price under the conditions indicated above.
6. DELIVERY
6.1 The Products ordered by the Customer will be delivered in metropolitan France and in the European Union. Customers residing in other countries should contact Sweet Almiraj via the Site to find out if a shipping solution is possible.
If the Products ordered have not been delivered within more than 7 working days after the indicative delivery date, for any reason other than force majeure or the act of the Customer, the sale may be canceled at the written request of the Customer under the conditions provided for in Articles L 216-2, L 216-3 and L 241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him no later than fourteen days following the date of termination of the contract, excluding any compensation or deduction.
Deliveries are made by the Post Office to the address mentioned by the Customer when ordering and to which the carrier can access. The Customer must ensure that he has communicated exact and complete information concerning the delivery address (such as, in particular: street number, building, staircase, access codes, names and/or telephone numbers). intercom, etc.). Delivery cannot be made to hotels or PO boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times.
The Customer is required to check the condition of the products delivered. He has a period of 3 days from delivery to notify Sweet Almiraj by any means of the problems observed.
Sweet Almiraj cannot be held responsible for any delay in delivery that is not of its making.
7. TRANSFER OF OWNERSHIP
7.1 The transfer of ownership of the Products from Sweet Almiraj to the Customer will only take place after full payment of the price by the latter, regardless of the date of delivery of the said Products.
8. RIGHT OF WITHDRAWAL
8.1 The right of withdrawal can be exercised online via a form to be completed available in the Customer order history, and can be exercised within fourteen (14) days of receipt of the order.
Returns must be made in their original and complete condition, allowing their re-marketing in new condition, and must be accompanied by the purchase invoice.
Damaged, soiled or incomplete Products are not taken back.
Return costs are the responsibility of the Customer.
9. PRODUCTS AND COMPLIANCE
9.1 The Products offered by Sweet Almiraj are presented on the Site and include a complete product sheet presenting the different characteristics of the said Product.
The Products offered by Sweet Almiraj comply with the standards applicable in France.
9.2 The Customer is informed on each product sheet that the Products are not suitable for children, their small size being able to cause risks of suffocation in the event of accidental ingestion. In addition, all precautions are taken during manufacture but it remains exclusively artisanal.
10. INTELLECTUAL PROPERTY
10.1 The content of the Site (https://www.sweetalmiraj.com) is the property of Sweet Almiraj and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.
11. APPLICABLE LAW – LANGUAGE
11.1 These T&Cs and the resulting operations are governed by and subject to French law.
11.2 These T&Cs are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
